A state appellate court ruling striking down New York’s ban on Section 8 discrimination has thrown the city’s already fragile voucher ecosystem into confusion, raising questions about how or if landlords can be compelled to accept subsidized tenants. A five-judge panel in the Appellate Division’s Third Department ruled the state’s source-of-income discrimination law is unconstitutional as it applies to Section 8 vouchers.
